About the establishment of the Social Development Fund of Forced Displaced Persons of the Republic of Azerbaijan
DECREE OF THE PRESIDENT OF THE REPUBLIC OF AZERBAIJAN
In order to strengthen the social protection of IDPs in the Republic of Azerbaijan and to implement the measures provided for in the State Program "On Solving the Problems of Refugees and IDPs", I decide:
1. The Social Development Fund of Forced Displaced Persons of the Republic of Azerbaijan should be established.
2. The Charter of the Forced Displaced Persons Social Development Fund of the Republic of Azerbaijan should be approved (attached).
3. The Cabinet of Ministers of the Republic of Azerbaijan should resolve the issues arising from this Decree.
4. This Decree enters into force on the day of its signing.

STATUTES
1. GENERAL PROVISIONS
1.1. The Social Development Fund of Forced Displaced Persons of the Republic of Azerbaijan (hereinafter referred to as the "Fund") is established by the decision of the President of the Republic of Azerbaijan under the Cabinet of Ministers of the Republic of Azerbaijan, and in its activities it implements the laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, this Charter. and based on Operational Management. Operational Management is a document defining the principles of the Fund's activities, this document is developed jointly by the World Bank and the Fund's Supervisory Board based on the agreement and consultations reached between the World Bank and the government of the Republic of Azerbaijan, and is approved by the Cabinet of Ministers of the Republic of Azerbaijan is done.
1.2. The foundation is a non-profit organization.
1.3. The fund is a legal entity with an independent balance sheet, bank accounts, an image of the State Coat of Arms, a seal, stamp, letterheads and other attributes with the name written in Azerbaijani and English languages.

2. PURPOSE AND DUTIES OF THE FUND
2.1. The main purpose of the fund is to implement measures that ensure the improvement of the housing and living conditions of internally displaced persons, to open jobs for them, to allocate funds for the implementation of micro-projects aimed mainly at the restoration of social infrastructure, and to ensure the efficient and purposeful use of these funds.
2.2. The Fund fulfills the following tasks: provides relevant information about the purpose of its activities to the central and local executive authorities, international and local non-governmental organizations, and the population; conducts surveys, conducts research and prepares specific proposals in order to improve housing and living conditions of internally displaced persons and create jobs for them; assists specialists and non-governmental organizations in the preparation and implementation of micro-projects; In accordance with the provisions of the Operational Management, it organizes the improvement, evaluation and acceptance of the submitted micro-projects, allocates funds for the implementation of those projects by conducting consultations in the Supervisory Board.
3. FUND RIGHTS
The fund has the following rights in accordance with the goals and tasks assigned to it:
Conducting transactions with legal and natural persons in the Republic of Azerbaijan and foreign countries;
To use the property at his disposal;
to purchase and lease various types of movable and immovable property in accordance with the legislation of the Republic of Azerbaijan;
Establish relations with enterprises and organizations, banks in the established manner;
Opening accounts in banks of the Republic of Azerbaijan, receiving loans in national and foreign currencies;
To use the services of independent experts and consultants to ensure the fulfillment of their duties.
4. PROPERTY OF THE FUND, FORMATION AND USE OF ITS FINANCIAL ASSETS
4.1. The fund's property consists of buildings, equipment, installations, vehicles and other property necessary for the performance of its duties.
4.2. The property of the Fund is considered state property and is assigned to the Fund for use on the basis of operational management.
4.3. The funds of the fund are formed at the expense of the following sources:
allocated funds according to multilateral and bilateral international programs;
financial resources allocated by the Republic of Azerbaijan;
voluntary donations made by legal entities and individuals;
funds and grants allocated by international and local non-governmental organizations;
other sources not prohibited by law.
4.4. As a non-profit organization, the Fund can use its financial resources only to carry out activities that are consistent with its purpose. Commercial activities of the Fund that are not directly related to its purpose are prohibited.
4.5. Issuance and transfer of funds on the accounts of the Fund is carried out by the order of the director and chief accountant of the Fund.
5. ADMINISTRATION OF THE FUND
5.1. The supreme governing body of the Fund is the Supervisory Board.
5.2. The powers of the Supervisory Board include: preparing the draft of the Operational Management;
To approve the activity program, annual budget and work plan of the Fund for each year;
To approve the organizational structure (structure) of the Fund;
To approve the report of the director of the fund;
To organize the auditor verification (inspection) of the financial and economic activities of the Fund and to confirm its results;
to approve the financing of submitted micro-projects;
Appointing and dismissing the director of the fund.
5.3. The Supervisory Board of the Fund consists of 9 members. The chairman of the Supervisory Board is the chairman of the State Committee for Refugees and IDPs of the Republic of Azerbaijan. The personal composition of the members of the Supervisory Board is determined by the Cabinet of Ministers of the Republic of Azerbaijan, and its composition includes representatives of the following organizations and international institutions:
Ministry of Finance of the Republic of Azerbaijan;
Ministry of Economy of the Republic of Azerbaijan
Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan;
State Committee for Refugees and IDPs of the Republic of Azerbaijan;
UN Development Programme;
US Agency for International Development;
Representation of the United Nations High Commissioner for Refugees in Azerbaijan;
State Support Council for Non-Governmental Organizations under the President of the Republic of Azerbaijan;
Entrepreneur.
5.4. Meetings of the Supervisory Board are held at least once every two months. If necessary, extraordinary meetings of the Supervisory Board can also be held. Meetings and decisions of the Supervisory Board are formalized with the protocol signed by the Chairman.
5.5. Decisions of the Supervisory Board are made by open voting. In the event of a tie, the chairman's vote is decisive. The decision of the Supervisory Board meeting has legal force if more than half of its members are present.
5.6. The operational management of the fund's activities is carried out by the director. The director is appointed and dismissed by the decision of the Supervisory Board of the Fund based on the proposal of the State Committee for Refugees and IDPs of the Republic of Azerbaijan.
5.7. The director of the fund cannot be a member of the Supervisory Board.
5.8. The director of the fund reports to the Supervisory Board and organizes the implementation of its decisions.
Director: organizes the activities of the Foundation. Represents the Fund in relations with legal and natural persons, operates without a power of attorney, makes decisions on demands and claims;
Approves the reports and work plans of structural units of the Fund;
Orders the use of the Fund's property and funds;
appoints and dismisses employees in accordance with the labor legislation;
Determines staff units of the Fund and distributes work among employees;
appoints the chief accountant in agreement with the Supervisory Board;
submits the Fund's annual report to the Supervisory Board for approval no later than one year after the end of the financial year;
It resolves other issues not related to the powers of the Supervisory Board.
5.9. The Fund's financial and economic activity is supervised by the Supervisory Board. The Supervisory Board organizes an audit of the Fund at least once a year.
6. ACCOUNTING AND REPORTING
6.1. The fund carries out operations, accounting, statistical accounting and reporting in the prescribed manner and is responsible for their accuracy.
6.2. The financial year of the fund starts from January 1 of the calendar year and ends on December 31.
7. REORGANIZATION AND TERMINATION OF THE FUND
7.1. Reorganization and liquidation of the fund is carried out by the decision of the President of the Republic of Azerbaijan.
7.2. After liquidation of the fund, the remaining property is placed at the disposal of the State Committee for Refugees and IDPs of the Republic of Azerbaijan.
